Booking Terms, Refund Policy, and Waiver

1. Accepting these terms

When you pay the deposit, sign a proposal, or use our photobooth, you agree to everything below. If you disagree, please do not proceed with your booking.


2. Booking and payment

  • Deposit: 30% of the quoted total is required to confirm your booking.
  • Balance: The remaining balance is automatically charged to your saved payment method 7 days before the event, unless we’ve agreed otherwise in writing.
  • Additional fees: Overtime, travel beyond 75 km of Winnipeg, parking, venue surcharges, or damage-related costs will be invoiced after the event and are due upon receipt.

3. Refund and cancellation

  • Full refund of deposit if:

    • You cancel in writing within 14 days of paying the deposit and
    • Your event is more than 30 days away.
  • Deposit is non-refundable if:

    • You cancel after 14 days of paying the deposit, or
    • Your event is less than 30 days away.
  • Within 7 days of the event:

    • Deposit remains non-refundable.
    • 50% of the projected balance will be due immediately.
  • Venue closure or government restrictions:

    • Deposit converts to a credit valid for 12 months, subject to availability.

All cancellations or rescheduling requests must be emailed to hi@moment.box.


4. Rescheduling

You may move your booking once at no cost if you give us at least 30 days’ notice and we have availability. Further or short-notice changes cost CAD 75 per move.


5. Equipment requirements and responsibility

Please provide:

  1. A standard 120 V power outlet within 25 ft.
  2. A flat, sheltered space at least 8 × 8 ft.
  3. Safe access for loading in and out.

You are responsible for loss or damage caused by guests or venue staff. Repair or replacement costs will be invoiced.


6. Event conduct and safety

Moment Box booths are unattended by default. You agree to supervise usage and remove disruptive guests. We may shut down the booth without refund if people or conditions put equipment or guests at risk.


7. Media ownership and promotional use

  1. Your ownership – All photos, GIFs, and videos delivered to you are yours to use as you wish.
  2. Our licence – You grant Moment Box a worldwide, royalty-free licence to copy, edit, and share selected event content in our marketing (website, social media, print, or ads).
    • We will not publish identifiable faces of minors without parental consent.
    • We will honour written requests to remove future usage; already-published media may remain in archives.
  3. Opt-out – Email us before the event or within 7 days of gallery delivery if you do not want us to publish your content. Opt-outs received after publication cannot be retroactively applied.

8. Waiver and release of liability

By booking, you and your guests:

  • Accept normal risks associated with photo equipment, props, printers, and lighting.
  • Release Moment Box and its staff from liability for injury, property damage, or loss, except where caused by our gross negligence.
  • Agree that any claim is limited to direct damages not exceeding the amount you paid for the services.

9. Service interruptions

We are not liable for delays or failures caused by circumstances beyond our control, including extreme weather, power outages, or venue restrictions. If our equipment fails solely due to our fault and cannot be fixed on-site, we will offer a pro-rated refund or credit.


10. Limits of liability

Moment Box is not responsible for indirect or consequential damages. Our total liability is capped at the amount you paid for the booking.


11. Governing law

These terms are governed by the laws of Manitoba, Canada. Any dispute must be brought in a Manitoba court within one year of the event date.
